A year and a half ago, Julian Stobbs and Myrtle Clarke were asleep in their home in Lanseria, Johannesburg. At one o clock in the morning, they were awoken with firearms pointed in their faces. Police had removed the main gate and stormed the property.
The police had recived a tip-off that the couple had a dagga laboratory in their home and that they were dealers. They were arrested and let out on R1000 bail. No laboratory was found but an illegal amount of dagga was confiscated from their home.
The couple, have been dagga smokers for years, ingesting it for their own recreational use. Fed up that they were assaulted and arrested in the privacy of their own home, they have decided to take the law into their own hands.
They plan to take their case of legalizing dagga to the Constitutional court later this year. They insist that their human rights have been trampled on and want the laws to change in their favour.
This will be the second time that a case involving the legalization of dagga will be heard in court.
